Terms of Use

1. Acceptance of Terms

By accessing and using the Sirius CRM platform ("Platform", "Service"), developed by ROI Labs, you agree to these Terms of Use. If you do not agree with any part of these terms, you must not use our services.

By creating an account, you confirm that you have read, understood and fully accepted these Terms, as well as our Privacy Policy.

2. Service Description

Sirius CRM is a SaaS (Software as a Service) customer relationship management platform that offers:

  • Kanban Pipeline for visual deal management
  • Contact and organization management
  • Email automations and workflows
  • Sales analytics and reports
  • Integrations with WhatsApp, Google Calendar and other tools
  • API for custom integrations

We reserve the right to modify, suspend or discontinue any feature at any time, with 30 days' notice for significant changes.

3. Plans and Payment

3.1. Available Plans

We offer plans with different usage levels. See our pricing page for details.

3.2. Payments

Payments are processed via Mercado Pago and renew automatically until cancellation. We do not store credit card data.

3.3. Cancellation

You can cancel your subscription at any time through account Settings. Cancellations take effect immediately, but you retain access to the plan until the end of the paid period. No pro-rated refunds.

3.4. Non-Payment

In case of payment failure, your account will be automatically downgraded to the FREE Plan. Data exceeding FREE limits will be archived but not deleted.

4. Registration and User Responsibilities

By creating an account, you agree to:

  • Provide true, up-to-date and complete information
  • Keep your password secure and not share it with third parties
  • Notify us immediately of any unauthorized use of your account
  • Use the service in compliance with local laws and these Terms

You are fully responsible for all activities carried out under your account.

5. Prohibited Use

It is expressly prohibited to use Sirius CRM to:

  • Send spam, phishing or unsolicited mass communications
  • Violate third-party intellectual property rights
  • Distribute malware, viruses or malicious code
  • Reverse engineer, decompile or modify the software
  • Attempt to access other organizations' data (multi-tenant violation)
  • Overload our infrastructure with abusive API usage
  • Resell or sublicense the service without express authorization

Violations will result in immediate account suspension, without refund.

6. Intellectual Property

6.1. ROI Labs Ownership

All code, design, brand, interfaces and features of Sirius CRM are the exclusive property of ROI Labs and protected by copyright and intellectual property laws.

6.2. Your Data

You retain all rights to the data you enter into the system (contacts, deals, pipelines, etc.). We are granted only a limited license to process this data solely to provide the service.

6.3. Feedback and Suggestions

By submitting suggestions, ideas or feedback, you grant ROI Labs the right to use, implement and commercialize those ideas without compensation or attribution.

7. Limitation of Liability

Sirius CRM is provided "as is" and "as available", without warranties of any kind.

We do not guarantee:

  • Uninterrupted service availability (99.5% uptime target)
  • Absence of errors or bugs
  • Specific sales or conversion results
  • Compatibility with all browsers or devices

Our total liability for damages is limited to the amount paid in the last 3 months.

We are not responsible for:

  • Data loss caused by user action
  • Third-party integration failures (Mercado Pago, WhatsApp, etc.)
  • Indirect damages, loss of profits or missed opportunities

8. Account Termination

8.1. By You

You can delete your account at any time through Settings. Data will be retained for 90 days for recovery and then permanently deleted.

8.2. By Us

We reserve the right to suspend or terminate accounts that:

  • Violate these Terms of Use
  • Are involved in illegal or fraudulent activities
  • Pose a risk to the security or stability of the platform

We will notify by email with 7 days' notice, except in cases of serious violation.

9. Changes to These Terms

We may update these Terms periodically. Significant changes will be communicated by email with 30 days' notice.

Continued use of the service after changes constitutes acceptance of the new terms. If you disagree, you must discontinue use and delete your account.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil, specifically the General Data Protection Law (LGPD - Law 13.709/2018) and the Consumer Protection Code.

The courts of São Paulo/SP, Brazil are elected to settle any disputes arising from these Terms.
